This Agreement for you outlines the terms and conditions that apply to your use of our services available in the domain and subdomain www. ticketbes.com / (“the site”). If you do not agree to our terms and conditions, you may not use or access our services.
Before you can become a user of the site, you must read, accept and agree to all the terms and conditions contained in this Agreement for you, which includes the terms and conditions expressly set forth below and those incorporated by reference. We may modify this Agreement with you at any time by notifying (“Warning”) by posting the modified User Agreement on the Site. Any modified User Agreement will regulate the registrations of new users from the date it is posted on the Site. The modified User Agreement will bind existing users after 30 days from the date of an alert. No other amendments to this User Agreement shall be effective.
This User Agreement is effective on February 10, 2019 for new registered users and is otherwise effective on February 4, 2018 for all users registered before February 10, 2019.
1 Eligibility for registration.
Our services are not available and cannot be used by persons under the age of 18 or for TicketBes temporarily or indefinitely suspended. If you are under the age of 18, you may only use this service together and under the supervision of a parent or guardian. If you are not eligible, please do not use our services. If you register as a business entity, you represent that you have the authority to bind that entity to this User Agreement.
2 User ID.
You must choose a user ID and password after registration is complete. You are responsible for all actions taken with such user ID and password and you will only need to use or use the Site using your user ID and password. You have to make every effort to keep your password safe and not reveal it to anyone else. You may not transfer or sell your user ID to anyone else. You also won’t allow other people to use your user ID or password directly or indirectly.
3 TicketBes is just a marketplace.
The Site serves as a marketplace, allowing registered users to offer, sell and purchase tickets, at any time, from anywhere, in a variety of price formats. We do not review the lists provided by users and never own the items offered through the site. As a result, we have no control over the quality, safety or legality of the items listed, the truth or accuracy of the listings, the ability of sellers to sell items, or the ability of buyers to pay for items. Do not assume that the offer, sale, purchase, export or import of any item is valid and legal simply because it is listed on the Site. We are not responsible for ensuring that buyers and sellers actually complete a transaction. You accept sole responsibility for the legality of your actions under the laws that apply to you.
3.2 Identity verification.
We use many techniques to verify the accuracy of the information that our users provide to us when registering on the Site. However, because user verification on the Internet is difficult, TicketBes cannot and does not confirm the alleged identity of users or the validity of the information that users post on the Site. We invite you to communicate with potential business partners using the tools available on the Site.

4.1 Dangerous decision of the supporter.

4.2 Seat assignment.
TicketBes reserves the right to update the customer’s seat(s) in the event that the place(s) ordered is unavailable or in the event that a seller defaults. Tickets, however, can never be downgraded without the buyer’s consent or at an agreed discount. The categories of seats (from worst to best) are as follows: short side of upper level, short side of lower level, long side of level higher level, long side of level lower level, VIP and categories of hospitality. We guarantee that all orders will be placed in a minimum of pairs unless it is indicated as “single places” in the restrictions.
5 Listing and sale.
5.1 List description.
If you are a seller, you must ensure that you are legally able to sell any item in a listing on the Site and that it is legal to sell that item to UK residents or (if the buyer is a resident abroad) that it is legal to sell and export that item to a person residing in the buyer’s jurisdiction. You must complete each section of the “Ticket Registration Form”. You are responsible for ensuring that you have the right to use all the contents of your ads and we have the right to host them on our servers.
5.2 Prohibition of cancellation.
You acknowledge that we will start providing you with our services as soon as you have completed and submitted the “Ticket Registration Form” and you can edit or delete the list 1 month before the event from my account. However, you won’t have the right to edit or delete the listing if there’s an order for your listed tickets.
Without limiting other remedies, we may suspend or terminate your account if we suspect that you have undertaken or are about to undertake, or that you have been in any way involved or linked to fraudulent activity in connection with the Site.
5.4 Failure to provide tickets
In the event that a supplier does not provide tickets sold on the “site”, TicketBes reserves the right to charge the cost of replacement tickets to the account of the “sellers”. If the cost of replacement tickets is higher than the account balance, the balance due must be paid to TicketBes within 7 working days of notification.
Registration with TicketBes is free of charge, although you will remain responsible for the costs of accessing our site and communicating with our users. We charge fees for the inclusion of items for sale through our site and when you enter an item you have the option to review and accept the fees that will be charged to you, which will be clearly indicated in the “Ticket Registration Form”. We charge commissions for the purchase of items through our site and when you purchase an item you will have the opportunity to review the fees that will be charged to you, which will be clearly indicated on the “Confirm purchase” page that you will have to accept to complete the transaction. In the event that we introduce a new service, the fees for that service are effective at the launch of the service.
Unless otherwise stated, all fees are payable in Euros. Whether you are a business or not, value added tax and other taxes may apply to your transaction. Sellers and buyers will be responsible for paying all relevant fees associated with using our service and website and all applicable fees. You agree that we may issue invoices electronically by email.
7 Your information.
“Your information” is defined as any information you provide to us or other users in connection with the TicketBes service including registration, listing (including, without limitation, any description of the items listed) and any other content you post within the site. You are solely responsible for your information and we act as a simple channel for your online distribution and publication of your information.
Your information and activities on our site must not:

or create liability for us or make us lose (in whole or in part) the services of our ISPs or other providers;
or connect directly or indirectly to include descriptions of goods or services that: (aa) are prohibited by this User Agreement; (bb) are identical to other items you have for sale but have a price lower than the reserve of your item; (cc) are offered for sale simultaneously on a website other than TicketBes (this does not prevent you from linking or advertising a TicketBesitem. from another website); or(dd) you do not have the right to link or include;
or contain computer viruses, macro viruses,Trojan horses, worms or anything else designed to interfere with, interrupt or interrupt the normal operating procedures of a computer or to intercept, access without authorization or secretly expropriate systems, data or personal information;

You also waive all moral rights you have over your information to the fullest extent permitted by law.

As a seller, you have access to your user ID, email address, and other buyer contact information, and as a buyer you have access to your user ID, email address, and other contact information.
By accepting this User Agreement, you agree that, with respect to the personally identifiable information of other users obtained through the Site or through a TicketBes-related communication or transaction facilitated by TicketBes,you may use such information only for: (a) TicketBes-related Communications that are not unsolicited commercial messages and relate to your genuine participation in a facilitated transaction, (b) using the services offered through TicketBes, and (c) any other purpose to which you expressly agree. In addition, you will only use this information in accordance with applicable laws and regulations, including, without limitation, data protection and privacy laws. In all cases, you need to give users the opportunity to remove themselves from the database and the ability to review what information you’ve collected about them. TicketBes and our users do not tolerate spam or unsolicited commercial communications. Therefore, without limiting the above, there is no need to add a TicketBes employee or a TicketBes user, not even a user who purchased an item from you, to your mailing list (email or physical mail) without their explicit written consent after proper information. Without limiting our other remedies, we may restrict your activity on the Site, immediately issue a notice, suspend or terminate your registration or any list of items, and refuse to provide you with our services without notice: (a) if you violate this User Agreement or incorporated documents by reference; (b) if, despite our reasonable efforts, we are unable to verify or authenticate the information you provide to us; or (c) if we believe your actions may cause us financial loss or legal liability.
9 Data transfer
We consider the protection of users’ privacy to be a very important COMMUNITY principle. TicketBes will store and transmit your information in a safe, confidential and secure environment. If you object to the transfer or use of your information, please do not register.
10 No warranty.
We (and our parents, subsidiaries, affiliates, officers, directors, agents and employees) do not grant continuous, uninterrupted or secure access to our services and the operation of the Site may be interfered with by numerous factors beyond our control. Our website and services are provided “as is” and as and when available and, to the extent permitted by law, we exclude all warranties, conditions or other terms implied, implied by law or otherwise, including, without limitation, terms relating to skill and care or timeliness of performance. Some jurisdictions do not allow the exclusion of liability for implied warranties, so the foregoing disclaimer may not apply to you.
11 Limitation of Liability.

13 Applicable law and legal compliance.

14 Dispute resolution.
Disputes between you and TicketBes regarding our services may be reported to [email protected] We encourage you to report any disputes between users to local law enforcement.
A person who is not a party to this User Agreement is not authorized under the Contracts (Rights of Third Parties) Act 1999 to apply any term of this Agreement to you, but this does not affect the rights of any third party or remedy specified in user’s agreement or that exists or is available separately from such law.
If any provision of this User Agreement is held to be invalid or unenforceable, that provision will be deleted and the remaining provisions will apply. Please agree that this User Agreement and all incorporated agreements may be automatically assigned by TicketBes in our sole discretion to a third party in the event of a merger, acquisition or any other event. You and TicketBes are independent contractors and no agency, partnership, joint venture, employee-employer or franchisor-franchisee relationship is construed or created by this Agreement with you. The titles are for reference purposes only and in no way define, limit, interpret or describe the scope or breadth of that section. Our inability to act against a breach by you or others does not waive our right to act in relation to subsequent or similar violations. This User Agreement establishes the full understanding and agreement between us with respect to its subject matter. No oral explanation or oral information provided by any party will alter the interpretation of this User Agreement.
Sections 6 (Fees), 7 (User Information), 11 (Disclaimer), 12 (Compensation), 13 (Applicable Law), 14 (Dispute Resolution) and 16 (Third Party Rights) will survive the termination of this Agreement with you.
TicketBes will not offer a refund unless an event is cancelled and rescheduled, in which case a 70% refund and a 15% discount will apply on future orders. Refund only applies to tickets (70%) as “the company” has the right to withhold its booking fee under consumer law. No refund in case of changes to event data, time of event and venue change or weather conditions. ALL TICKETS PURCHASED ARE FINAL! TicketBes source of tickets for sold out events, there will be occasions when the specific location of the ticket is not available, and on this rare occasion a CREDIT NOTE will be issued for the difference between the one purchased and those provided. We recommend that you book your tickets after the TV companies have confirmed the dates on which the matches will be played. Ticketbes will only offer refunds if the event is cancelled and not rescheduled. If you can no longer attend the rescheduled event, we will list tickets on sale on our platform and try to sell tickets on your behalf. In case of sale you will be subject to the sales commissions described above.
This section deals with delivery methods and times. We guarantee that tickets will be delivered before kick-off. In some cases tickets can be delivered on the day of the event. We use registered delivery methods including: Royal Mail Special Delivery, UPS, DHL and private courier. TicketBes assumes no responsibility for the loss of tickets if the “buyer” provides incorrect delivery information. TicketBes assumes no responsibility if tickets are sent to a sorting office because the buyer is not registered for tickets. From time to time we reserve the right to request delivery at stadium pickup to ensure that you receive your tickets safely and as some stadiums require our sellers to have to pick up at the box office on match day. Before kick-off an email will be sent with the details of the collection.
18 Termination of the contract
TicketBes reserves the right to cancel this contract if it is detected and reported that offensive language, threats or aggressive behavior is performed by third parties, buyers or sellers involved in a transaction on the “Website”, via Live Chat, telephone, email, or in person. In this case, a full refund will be made and the user will be blocked from the “site”.
